Welcome to Aligner Hub, operated by Cubesly Inc. (“we,” “us,” or “our”). By accessing or using our platform, you agree to these Terms and Conditions. If you do not agree with these terms, you must not use our services.

2. Definitions

  • “Platform”: Refers to the Aligner Hub website and any associated services.
  • “Users”: Refers to both Customers (e.g., doctors, dental practices, dental labs, existing aligner businesses) and Service Providers (e.g., digital treatment planners, physical aligner manufacturers).
  • “Customer”: Any user who engages the services of a Service Provider via our platform.
  • “Service Provider”: Any user who provides services (digital treatment planning, physical aligner production) through our platform.
  • “Patient Data”: Refers to the sensitive personal and medical information uploaded by Customers about their patients, including but not limited to name, age, gender, main complaint, prescription, images, 3D models, and X-rays.

3. User Responsibilities

  • Account Creation: Users must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.
  • Prohibited Conduct: Users must not engage in illegal activities, misuse the platform, or violate the rights of other users.
  • Compliance: Users agree to comply with all applicable laws and regulations, including those related to the handling of patient data.

4. Services Provided

  • Overview: Our platform connects Customers with Service Providers who offer digital treatment planning and physical aligner manufacturing services.
  • No Medical Advice: We do not provide medical advice, diagnosis, or treatment. The responsibility for medical decisions rests solely with the Customer and their Service Providers.

5. Payment Terms

  • Fees and Charges: Customers will be charged for services rendered by Service Providers. Payments are processed via Stripe, and we do not store credit card information.
  • Payment Processing: By using Stripe’s API, payments are securely processed, and customers agree to Stripe’s terms of service.
  • Refunds: Refund policies will be governed by individual agreements between Customers and Service Providers.

6. Patient Data Handling

  • Patient Data Upload: Customers may upload sensitive patient data to the platform. You are responsible for obtaining the necessary patient consent to share this information.
  • Data Usage: Patient data will be used solely for the purpose of providing the requested services and will be shared only with relevant Service Providers.
  • Data Security: We employ industry-standard measures to protect patient data, but we cannot guarantee absolute security.

7. Intellectual Property

  • Ownership: The platform and its content, including text, images, and software, are owned by Cubesly Inc. or licensed to us.
  • User Content: Users retain ownership of the data and materials they upload but grant us a license to use this data to provide the services.

8. Limitation of Liability

  • No Warranties: The platform is provided “as is,” without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of the services.
  • Liability: Our liability is limited to the maximum extent permitted by law. We are not liable for indirect, incidental, or consequential damages.

9. Dispute Resolution

  • Governing Law: These Terms and Conditions are governed by the laws of Ontario, Canada.
  • Dispute Process: Any disputes arising from these terms will be resolved through binding arbitration in Ontario, Canada.
